Are Power Projects Covered by the Buildings & Other Construction Workers Act? Seeking Advice

Please advise whether provisions of the Buildings & Other Construction Workers Act-1996 are applicable to the power project industry.

Whereas all legal provisions have been made applicable to us by the Factories Act as it is central legislation. Other service conditions are applicable to us by Model Standing Orders.

Please clarify whether you have obtained a license under the Factories Act of 1948. If you have obtained a license under this act and the manufacturing process has already commenced, then the Building and Other Construction Workers (BOCW) Act of 1996 will not be applicable to your power industry. Therefore, the applicability of Sections 6 and 7 of the Factories Act is necessary, along with the rules of the respective state, for the Factories Act to be in force.

If your industry is registered under the Factories Act and complies with Sections 6 and 7, then you do not need to worry about the BOCW Act.

Is a group housing society in Faridabad required to register under the BOCW Act 1996 in Haryana, or is it the contractor who needs to be registered under the BOCW Act?
