Can the memorandam of charge be distributed by disciplinary authority, when the charges are not established and the keeping in view the confidentiality of disciplinary proceeding for govt. employees. Can a case of defamation be filed againt the disciplinary authority or employer.
Disciplinary proceedings are instituted commonly on the basis of material
secured in what is known as a preliminary enquiry conducted by the department on receipt of a complaint and at times on the basis of a well-documented allegation straight away without conducting a preliminary enquiry.
The basis of initiation of disciplinary proceedings cannot be questioned.
