ESIC Name Change Process After Marriage: Maternity Benefits & Documentation

Hello friends,

I have a query. One of our female staff is married, but due to the unavailability of a gazette copy regarding the change in her name, I have not changed her name on the ESIC card. Now, the situation is that she is pregnant. Without the receipt of the gazette copy, should I change her name on the ESIC card? Will she be able to get maternity paid leave facility from ESIC with the same name or not?

Hi,

As per my knowledge, you can also change her name with the help of a copy of the marriage certificate along with an application from her and a supporting letter from the employer.

Dear Sir,

The ESIC department cannot refuse to provide the benefits in any situation, whether she is married or unmarried and pregnant, because she is contributing and eligible for all medical benefits.

The company should submit Form 1 with the new details of her family, such as the husband's name, and also attach her affidavit about marriage details (both ID proofs should be attached). If the Branch Manager refuses, then contact the special cell of the Regional ESIC office regarding this matter.

If she is an adult, the department must be liable to provide all benefits regarding sickness and maternity.

Yes, she has a copy of the marriage certificate, but her old name is mentioned on the marriage certificate. When we ask the ESIC Branch office for a change in name based on this, they are asking for a gazette copy.
