Can I Be Charged for Not Serving Notice After Attending Only Induction? Seeking Legal Advice

karthik_srs
Dear Sir/Madam,

I received an offer from a reputed Indian company a few days ago, and I accepted the offer and attended a 2-day induction program. However, I did not go to the company from the third day onwards and sent a resignation email to the concerned HR on the morning of the third day. The notice period of the company was 90 days. Will the company have the right to recover the notice period amount even though I only attended the induction? If yes, what are the consequences if I don't pay them the same? Which laws can help me in this situation? Can I go to the labor court in that case? I do not need any relieving letter from the organization.

Thank you.

No need. Your PF account would not have been opened, so there are no proper records for them to get that 90-day amount from you.

Dear Karthik,

If you have signed any contract before accepting the offer, some organizations ask you to pay a penalty even if you serve for only two days, citing recruitment costs.

No need to pay any compensation. Whether you have signed any agreement with the company, even then, you may prove that the agreement is one-sided only and may escape. Don't worry. All the best in your new career.

Hello,

I guess even if you had not resigned, it would not have created any problems. It takes approximately 7 to 15 days to create a PF account, so your account was yet to be created, and hence you don't have to worry about that.

Hi,

You already accepted the offer and attended the induction program, so why are you not continuing the service? May I know the valid reason because you are wasting your time as well as your new company's time.
