Is My Security Person's Bill Correct? Seeking Clarity on Statutory Dues

Dear All Senior,

I am working in a company in the HR Department. I am confused about my security person's bill. He is claiming in his bill 45.08% statutory dues. The details of statutory dues are given below:
- PF + FPF + PF admin link = 13.61%
- ESIC = 4.75%
- Bonus = 8.33%
- Annual Leave = 5.8%
- National Holiday = 1.66%
- Uniform & seasonal wear = 5.00%
- Gratuity = 2.4%

So, all of you are requested to kindly provide me with correct information about this. Is he right or wrong?

All of these things are calculating the minimum wages given to guards and security supervisors. For example, security guard wages (basic + VDA) = (2535 + 1999.44) = 4535. Security supervisor wages (basic + VDA) = (3090 + 2437.18) = 5528.

Do you have any agreement copy with you? On what basis has he prepared the bill? Please clarify with the security supervisor. How can the forum help you in clarifying your bills?

Dear Sir,

I think you should call a security company in place of a security person. This is the right bill, but the claim manner is wrong. So, you can pay him the same amount, but make sure that he also pays your guard as per the claim components.

You should collect the PF number, salary register copy, EPF challan, last return of ESI, EPF, LWF, and paid bonus register copy. Check all your guard's date of joining, then check the eligibility of gratuity.

You need to check the original agreement between your company and service provider. The service provider is liable to charge you for PF, ESIC, Bonus, etc., but pay him after checking his records of paysheet, PF, and ESIC numbers of the personnel deputed at your premises. Gratuity and bonus should not be part of the monthly billing.

Dear All,

The bill for the security guard is paid as per the DGR rate, which is decided by the government for ex-servicemen only. It is not applicable to civilian guards; it is only paid to ex-servicemen. It is the correct bill to be claimed by security guards if they are ex-servicemen. You may refer to the DGR rate circular.

All payments as per agreement & bonus amount maximum Rs. 292/- (8.33% of Rs. 3500/-) as per the Bonus Act.

The security bill is correct. Statutory dues are as per the rates laid down. Additionally, security is 24/7, and whether it is Diwali or Holi, you require your guards. Therefore, you have to pay for national holidays, weekly offs, etc., as per labor rules. The uniform allowance is as per the agreement generally.

You seem to be confused. If you have hired the person for security duties on the company's payroll, then refer to the details given in the offer/appointment letter. If it is through an agency, then review the contract signed with the agency. The contract should have provided a breakdown of each detail or it might have been a lump sum for each individual's pay. In that case, it is the agency's responsibility. It appears that the issue lies with the security agency. Feel free to come back for any clarification.

If it is through an agency, review the contract signed with the agency. The breakdown of each detail should have been provided, or it could have been a lump sum for each individual's pay. In that case, it becomes the responsibility of the agency.

Though Bill seems to be correct, service tax is still not added. What about his service charges?

It is always an agreement that an employer makes with a contractor. As far as DGR is concerned, it is a site where you can find the rates and liabilities of security personnel. (Just search on google.com)
