Understanding PF Registration: Is It Necessary for Companies with Over 30 Employees?

Dear Sir,

We have a total of employees in our organization more than 30, and the basic salary of all exceeds Rs.10,000. Is my organization required to get registration under the PF Act? If yes, should our organization file a return as NIL contribution?

Dear,

You have to register your company with the PF authorities as the act states that in any establishment or factory where 20 or more persons are working or have worked on any day, the act applies regardless of their salaries.

All is right, and you have to take the code and send a nil return if all employees are exempted. However, you still have to deposit Rs7 per month as inspection charges, and you have to go through an inspection by PF authorities.

Firstly, could you please inform me where your organization is located? Additional documents may be required based on the location. Below is a list of new coverage requirements for obtaining a new PF code:

1. Coverage Performa
2. Business Performa
3. Company address proof
4. List of employees with Basic+DA
5. Demand Draft (DD) in favor of RPFC or EPFO for Rs....... (equivalent to 25.61% of basic salary for covered employees) along with the Challan.
6. Address proof of Director/Proprietor/Partner
7. Copy of MOA (if company directorship)
8. Copy of PAN/Service Tax/Sales Tax/TIN, etc.

If you are unable to proceed with this, you may consider hiring a consultant who can assist you for a reasonable fee. Further details can be discussed through communication.

Sorry, Ashok Ji, I do not agree with you because if any person is a member under the EPF scheme before the job, then he is liable to be covered under the EPF Act. Secondly, it depends on the company policy.
