Unpaid Salary After Sudden Termination: What Steps Should I Take Next?

I need your valuable suggestions. I was working in a company from December to March. The company did not provide me with an offer or appointment letter. At the end of February, they issued me a warning letter until the 31st of March due to non-productivity. Suddenly, on the 12th of March, they terminated me and advised me not to come the next day. They mentioned that they would give my full and final salary for February and March in 2-3 days. However, to this date, they have not paid me my salary.

Please suggest a course of action.

It seems that in a hurry to join the company, you have signed all documents, and the company has kept them for themselves without providing you a copy. Every employee is entitled to receive their salary after legal deductions as per the Indian Payment of Wages Act. Freezing or holding salary is illegal in India, and it is termed as non-payment of wages.

First of all, you need to ask your company to provide details of your appointment terms and conditions, the reason for marking you as a non-performer, along with details of the salary hold, and request payment within the stipulated timeframe. If your salary includes a commission, you will receive only the minimum amount fixed for your position. You may search the internet for the appropriate wording for a formal notice, or contact the labor officer in your jurisdiction.

I was working with a branded company that started a new non-banking finance group in September 2012. I joined this organization on September 28, 2012, as a manager with a fixed package of 4,50,000 plus variable components. However, they started putting high pressure on generating business. On November 27, 2012, one of my cheques bounced from a customer, leading the company to automatically resign me from the system and put my salary on hold. My supervisor emailed my HR manager and regional head on November 30, 2012, requesting to hold my salary due to the cheque bounce incident.

Subsequently, on December 6, my supervisor informed me that I was relieved from the system on November 27 and asked me to return my corporate SIM card. I submitted a written resignation on December 6, which my supervisor accepted and noted my relief date as November 27. I have been following up with the HR manager for my salary, but he mentions it is still under process. On the other hand, my regional head states it is a compliance issue. Kindly assist in resolving the matter regarding my salary.
