Is It Legal to Work Full-Time in HR and Freelance in Recruitment? Seeking Advice!

Hey guys,

I need your assistance regarding dual employment. One of my friends is working as an HR in an IT company, and he has got an opportunity to work as a freelancer in recruitment. I would like to know if it is legal for him to work in both roles.

Please suggest to us on the same as soon as possible.

As per my opinion, he can work as a consultant/freelancer if the present employer accepts, but he should declare total income to the Income Tax Department. It means he should file IT Returns with a consolidated total of his income. If his total income is below Rs. 1,60,000/- after all deductions/allowances as per IT, then there is no need to pay tax. If his income is still higher, he has to pay tax as per IT slab rates.

In my view, it is not illegal, and I don't think it comes under tax. Hmm, no need to pay tax, but I am not sure. Let's see our seniors' opinion.

Dear Karthik,

It completely depends on the regulations of the first company or the company in which he/she works full-time. Normally, a company won't allow its employees to engage in any other freelancing or part-time work. However, it still depends on the management of the company.

If it does not affect his normal duty, he can proceed. Many higher officials are engaging in dual employment without others' knowledge. What can we do?
