Leaving Job Without Notice: How Can I Withdraw My PF Without Employer's Attestation?

I am leaving my present company and want to withdraw my PF amount, but I can't get the required withdrawal forms attested by my employer due to short notice resignation. Additionally, the new company I am joining does not have a PF facility. What can I do? Is there any way I can withdraw my PF amount without an attested PF withdrawal form?

Hi, as per the law, the employer doesn't have any right to stop you from withdrawing your P.F under any circumstances. In your case, I think they are scolding you because you left without notice or with short notice. Anyway, it would be better for you to go and talk to them again politely and explain the need for the money, etc. I believe they may understand and fulfill your needs.

This happened to you because you did not complete your notice period.

Your Problem Solution:

First, fill out Form No. 19 and 10C, mentioning your P.F. numbers.

Second, find the authorized P.F. signatory. They may belong to the HR Department or another department (Accounts). If they are from another department, obtain their signature on the form outside the company (BY HOOK OR BY CROOK).

Do not forget to attach a current 3A copy.

The company has a policy of a 1-month notice from the day of resignation, but I only have 10 days. I need to get the director of the company to sign the PF withdrawal form. Niyaj, my risk-taking brother, is now involved. What should I do?

PF Withdrawal Process Without Employer Attestation

PF withdrawal can be signed by a Gazetted officer and submitted to the concerned PF office. The PF office will then send the form to your previous employer for Form 3A and signature on the forms. Your employer cannot reject the form; they must submit this form to the PF office along with Form-3A. You will receive your money in your bank account.

Below is an extract from the FAQ section of the EPFO website that directly addresses your issue:

Procedure for Members if Employers Do Not Attest Claim Forms

It is the duty of the employer under the Act & Scheme to assist the Employees' Provident Fund organization in settling the Provident Fund dues of their employees. The employer must complete the prescribed application within 5 days of receiving the forms and hand them over to the member when they leave the service.

In cases where a member encounters difficulty in getting the form attested by the employer, they can seek attestation from any of the following officers and submit it to the Provident Fund office:

- Manager of a bank.
- Any gazetted officer.
- Member of the Central Board of Trustees/committee/Regional Committee (Employees' Provident Fund Organization).
- Magistrate/Post/Sub Post Master/President of Village Panchayat/Notary Public.

I've worked in Pune for 9 months and got transferred to Chennai later in the same company. However, my PF account is registered in Maharashtra. Recently, I've moved out of the firm, and to withdraw the PF, they provided me with a PF withdrawal form for Tamil Nadu. Please let me know if I need to contact my employer to request a Maharashtra PF withdrawal form.

Withdrawal forms throughout India are the same. If your account is still maintained in Maharashtra, your form will go to Maharashtra. If it is maintained at the EPFO in Chennai, it will be sent there by the employer for settlement.

Dear All, I am leaving my present company (Ferro Alloys Corporation Limited) from August 2011. Due to my financial problems, I want to withdraw my PF amount but can't get the required withdrawal forms attested by my employer. This is because I resigned with a one-month notice period by giving a PL Leave application. As per the rules, the employer cannot withhold the PF dues of any employee. For your kind information, I have filled out my Form Nos 10C (pension amount withdrawal) and 19 (PF withdrawal) and submitted them to the authorized signatory of the company. However, to date, they have not taken any action, nor have they accepted my resignation or removed my name from the company roll. The management refuses to sign the withdrawal forms. Please help me and give advice regarding my issue urgently.

You can complain to the Regional Provident Fund Commissioner concerned. He will get the form attested by the employer.

You have not mentioned your age and what you are doing now. This information is required for giving proper advice. However, assuming that you are 58 years old or above and also assuming that you are not employed and contributing to EPF, the following advice is given:

You can fill up Form 19 and Form 10C and send them to your old employer (Private EPF Trust). Form 19 is meant for the settlement of the EPF amount, and Form 10C is for the settlement of the EPS amount. They will settle your account. Please do not worry whether your account is operative or inoperative. That will slightly affect the interest calculation only.

Thank you, I'm 40 years old. My current company doesn't provide a PF facility. Would it be better to show myself as unemployed? What about the location? I'm in Delhi, and the PF trust is in Mumbai. Please advise if I want withdrawal.

Before applying for PF withdrawal, your KYC, i.e., Aadhar, PAN, and saving bank account, must be approved by your principal employer. Then you can be eligible for withdrawal.
