Learned members defined the badli worker correctly as a worker who is appointed in the post of a permanent worker or of a probationer who is temporarily absent.
As defined badli worker is given a job when there is temporary absence by any regular worker. In textiles this badli worker system was in vogue.
In this system, badli workers used to report the gate of the mill every day every shift and if any permanent / regular worker remain absent then the supervisor had a choice to select a person present at gate from badli pool and put him on the place of permanent / regular worker who remained absent.
I am not aware of this system being run today also. But if it is there, the badli person should be taken into PF, ESI and Labour Welfare Fund. Badli workers of Mumbai Textiles are exempted from Profession Tax. They were badli workers for many years even more than 15 years with out any claim of whatsoever nature.
Such badli workers do not work for 240 days in any 12 months so they can not claim permanency. They get the work as and when available due to temporary absence by regular worker.
If any regular worker proceeds on leave then there was a practice of filling leave vacancy and not to take any person from badli pool.
