Provident Fund Deductions: Can Employees Opt Out If They're Not Interested?

Is it necessary for a company to deduct Provident Fund (PF) from an employee's salary if the employee is not interested in Provident Fund (PF)?

If his basic salary is more than 6500/-, then it is not necessary for a company to deduct Provident Fund.

Basic salary above $6500, no action required. However, if the individual has previous work experience with PF deductions that have not been withdrawn, it is necessary.

Hi Tarang,

I have a query. My team size will cross 20 pretty soon. The lowest salary in our firm is INR 350,000 per annum. Are we required by law to go in for PF?

Thanks.

I have been working in a Pvt. Ltd. company for the last 1.6 years. The company's employee strength is more than 20. When I joined the company and inquired about the PF facility, they told me they don't provide PF. My basic, as per my appointment letter, is 13,500/-. I wanted to opt for PF, but as my employer said they don't provide PF, I had no other option but to accept the appointment as I was in need of a job at that time, and I was also unaware of PF rules and laws. Now, one fine day, I applied for a car loan for which I was required to present my salary slip, and I came across this unusual figure that my basic, as per my salary slip, is 12,000/-. The employer has still not given any satisfactory answer to me about this error.

Another day, my employer distributed a form related to PF and told us, "please fill all your details for whoever is interested in obtaining PF." We filled the form and submitted it to our accountant. Now, my query is, am I entitled to PF whenever I leave this organization?

Also, there have been many instances when my employer gave away some part of the total salary in cash. Is it really okay to give away some part of the salary in cash? One last thing I want to mention is I have to request my salary slip time and again, and my employer is always hesitant in providing me with my monthly salary slip. I have seen that on paper, 6,500/- has been mentioned as the salary given to peons and guards, but in reality, they just receive not more than 3,000/-. What is this all about? Is there any kind of fraud going on to save tax, etc.?

I would appreciate some of the experts here to please comment on this and provide me with the exact rules and regulations.

Thanks

I want to know if any employer wishes to stop the PF facilities for the employees, is it required to add the employer's PF share to the employees' gross salary?
