Facing Unfair Dismissal and Harassment: Can I Seek Help from the Labor Court and Police?

I am working in an MNC (HSBC INVESTDIRECT SECURITIES INDIA LTD) for the last 4 years. I joined as a customer support officer (operations) and was in operations until September 2008. I was transferred to sales by the management for their convenience, offering false promises of a salary hike, support, and six months to prove myself. However, from the first month onwards, they started targeting and harassing me, pressurizing me by all possible means and methods. They often demanded my resignation, threatening termination otherwise.

After enduring mental torture for six months, I escalated the issues of bullying and compliance (forgery of insurance documents) to senior management, hoping they would consider the facts. But, instead, I faced more pressure and torture from the local management, who degraded, isolated, and demoralized me, even misrepresenting facts to senior management. I was then transferred to an A+ category branch with doubled targets, without any hike or official communication from HR.

Realizing the management's intentions, I requested to be transferred back to operations. However, without considering the facts and possibly for raising compliance issues, I was terminated on March 8, 2010. The HR Head came to the branch, handed over the termination letter, and obtained acknowledgement from me without prior notice or proper reason.

Now, I want to know how to proceed further. Can I file a complaint at the local police station? If yes, what charges should I include? How should I approach the labor court?

I have sent a representation to the Chief Labour Commissioner (CLC), who forwarded it to the Regional Labour Commissioner in Hyderabad to resolve the issue. Unfortunately, instead of resolving the matter, the Regional Labour Commissioner seems to have colluded with the HSBC management, further harassing me.

Please advise; I am waiting for your suggestions.

Dear Friend,

You should consult a good lawyer and give notice to the employer. Thereafter, proceed with litigation in the Labour Court for illegal dismissal.

Hi,

You should not have accepted the termination letter. No termination letter can be issued unless a valid reason is mentioned in the letter. Please let me know the reason mentioned in the termination letter. By accepting it, you have also accepted the reason for termination. If such things happened to you, you should have filed a mental harassment case with the local police station, copying the higher management.

In this case, you can approach the labor court as you fall under the same category, provided you have sufficient proof that you are a good performer.
