Dear Dipaknsk,

Welcome to CiteHR. To get better and complete solutions to your queries, you must furnish all relevant information about your organization, the applicable laws/Acts, location, size, type of business activity, etc.

Whether it is a union leader or an employee, I trust that you must have a provision/list of "misconducts" in your Standing Order, Conduct & Discipline rules, Code of Ethics, etc., to deal with the situation.

Warm regards.

Dear Dipaknsk,

Immediately, that person should be referred to the Medical Board, and based on the result, departmental action should be taken.

Any employee, including a union leader, is amenable to disciplinary rules followed by the company. A union leader gets some privileges under the ID Act of 1947, but discipline is not covered in it.

Any person found drunk while on duty should be referred to a doctor to determine whether they are under the influence of alcohol. If they are found to be under the influence of alcohol, they should be suspended immediately, and further disciplinary actions, such as the issuance of a charge sheet and an inquiry, should follow.

Hi friend,

Please verify the truth first regarding whether he was found drinking at the workplace. After that, issue a chargesheet explaining the complete details of the events and instruct him to submit an explanation as per the Standing Orders Act of 1946.

If we conduct such medical tests through:

1- Our Medical Officer, or

2- MBBS Doctor of the Hospital on our panel is valid

or

Only the Doctor of the Civil/Government Hospital is authorized.

Kindly clarify.

Everything depends on the influence he has on the workmen and management. Legal actions are secondary because production is the first priority.
