How Will the ESI Wage Ceiling Increase to Rs. 15,000 Impact Employees' Social Security?

The Employees' State Insurance (ESI) Corporation has approved an enhancement of the wage ceiling from Rs. 10,000 per month to Rs. 15,000 per month for the coverage of employees under the ESI Scheme. This decision was made during the 149th meeting held on Friday under the chairmanship of Union Minister of Labour and Employment, Mallikarjun Kharge.

Union Minister of State for Labour and Employment, Harish Rawat, and the Vice-Chairman of ESIC were also present at the meeting.

Taking into account the increase in the cost of living index and the recommendations of the Parliamentary Standing Committee on Labour, the Corporation increased the wage ceiling limit for the coverage of employees under the ESI Scheme.

This adjustment will enable the Corporation to extend a social security net to more employees in the organized sector.

It has been decided in the 149th meeting, and a notification from the corporation is awaited. The notification will be issued this month, and the same will be effective from April 1, 2010.

There are no such notifications as of now. Our ESIC Inspector has not clarified anything as such. If it happens, each factory and company registered under the ESIC Act will be sent a notification.

It takes a few weeks to implement because any changes in the slab need cabinet approval before implementation. According to sources in the Ministry of Labour, it would be implemented from 1st April 2010. The limit of PF is also set to be revised during this budget session. Please wait for the notification.

After tying up with various private hospitals/institutions, ESI has become a solid social security scheme (in my opinion). I will provide only one example to support my complaints.

I agree that there is not good infrastructure/service in ESI hospitals. However, if you refer to a private hospital, you can receive more expensive benefits free of cost. For instance, if you or a family member undergo a heart operation at a private hospital, the total expenses may come to approximately 2 lakh rupees or more. Your contribution of Rs. 14,500 per month amounts to Rs. 943. Your total contributions can cover the expenses of a heart operation after 18 years of regular contributions. Subsequently, you can avail of more benefits for yourself or your family members.

Dear Sachdeva,

You are suggesting that the ESIC hospitals are not good. Please ask the workers of any factory about the ESI hospitals and dispensaries; they will give you a real picture. ESIC hospitals/dispensaries should have more medicines. Unfortunately, even around Chennai, the hospitals do not have enough basic medicines. This is a fact. As you mentioned, the number of workers receiving heart surgery or other high-cost treatments is likely around 1%.

Inadequate facilities result in workers not choosing to go to ESIC hospitals/dispensaries. While the decision to increase the ceiling is good, authorities must take action to improve the conditions of the hospitals. This would be a real benefit for those low-income workers.

The discussion on raising the ceiling is ongoing and has yet to be converted into law. Many discussions have been held on this issue.

ESI is one of the best schemes our country has. However, due to our political system, not all good schemes are reaching the people. We have to blame ourselves only. How many members have relatives or fathers working in government departments and are honest? Before blaming the system, let's first set our house in order.

First, let's tell our relatives and friends working in government departments to be honest. Then the whole country will be better.

For example, once a year, all schools can take students to public places and ask them to clean up, displaying a board saying "Help keep this place clean." However, the next day, the same students, while out with friends or family, make the public place dirty by throwing away empty ice cream cups and other wrappers. What's the point of blaming society then?

ESI Corporation approves Enhancement of Wage Ceiling Limit from Rs.10,000/- to Rs. 15,000/-

The ESI Corporation has approved to enhance wage ceiling from Rs. 10,000/- per month to Rs.15,000/- per month for coverage of employees under ESI Scheme in its 149th Meeting held on today i.e. on 19thFebruary, 2010 under the chairmanship of Shri Mallikarjun Kharge, Union Minister of Labour and Employment. Shri Harish Rawat, Union Minister of State for Labour & Employment and Vice Chairman, ESIC was also present in the meeting.

Keeping in view the increase in cost of living index and recommendations of the Parliamentary Standing Committee on Labour, the Corporation increased the wage ceiling limit for coverage of the employees under the ESI Scheme. This will help the Corporation to provide Social Security net to more and more employees of the Organized Sector.

The Corporation also decided to enhance the benefit rates for Permanent Disablement and Dependants' Benefit for those beneficiaries who are on the rolls of ESIC for getting life long benefits under these two types of benefits. These benefits entitle the beneficiaries to get a monthly amount for whole life in case of Disablement and Death. This has been done to compensate the beneficiaries against erosion in the real value of these monthly benefits due to inflation.

In the meeting, ESI Corporation has also approved Revised Estimates of ESIC for current financial year and Budget Estimates for the year 2010-2011. An Amnesty Scheme has been approved by the Corporation for withdrawl of criminal cases filed against Insured Persons and Employers under Section 84, 85 and 85-A of ESI Act, 1948 and settlement of cases filed by the employers under 75 of the ESI Act. Provisions of primary and secondary medical care services in areas/districts where the existing ESI Hospitals are more than 25 Kms away and population of Insured Persons is more than 25000 in the areas, has also been approved by the Corporation in today's meeting.

Please express your views. The Central Government on 26th February 2010 issued a Draft Rules Amendment Notification to amend the wages ceiling to Rs. 15,000.00 from Rs. 10,000.00, and the time frame for this draft notification is 30 days.

The amendment may be effective from 1st April 2010, even if it is notified in May 2010. Please advise your accounts department to be ready to implement the same.

In case you have any objections, please email to sd.xavier@nic.in with your objections/views. The last date for submission is 31st March 2010.

ESIC has to issue a circular to all units or a public notification in mass media; only then are units liable to act. This is a fundamental right. Henceforth, when we discuss, please inform members that these are proposals only. Also, as HR professionals, we should understand that any changes in the law require notification and a public circular from the concerned departments. Even if any local official demands it, we have the right to ask for notification copies. Alternatively, the notification should be displayed on the local office notice board and their official website.

As I see, most employers will now have to take certain steps besides paying for mandated contributions, namely:

1. Delete employees now eligible from existing private group health insurance.
2. Continue health insurance coverage over and above ESIC.
3. Increase Salary Levels for employees by at least 4.75% to exclude them from ESIC.
4. Combination of options 2 & 3.
5. Combination of options 1 & 3.
6. Any other, please specify.

I really agree with Mr. Dixit; it's really very difficult to receive treatment from the list of ESI hospitals. First of all, you can only receive treatment from the dispensary mentioned on your card. If an employee changes his job location, it's very difficult to change the dispensary, as my employees often get moved from one site to another.

Yes, it's helpful in some ways for minor injuries that can be tolerated for a day or two.

Kindly send me a copy of the notification for my reference.

Furthermore, now a female employee is receiving a salary of Rs. 12000/-, and starting from 01.05.10, her contributions will begin. However, can she still be eligible for maternity benefits even though there has been no contribution in her name for almost a year? How will she be able to receive the benefits?

Kindly provide me with a response.

Hi all,

I want to know if an increase in the ceiling will really help the employees who are newly going to be covered. In order to benefit from ESI, the insured person has to go to the ESI office several times. Let me take my case; due to the new ceiling, I will save around Rs 880 per month, which amounts to approximately Rs 10,560 annually. With that amount, I can opt for private medical insurance, where I and my family can receive treatment in corporate hospitals.

In ESI, there is a cutoff in the wage per month to avail benefits for parents. I would appreciate all your comments on this.

Dear All,

The ESI Corporation has approved an increase in the wage ceiling from Rs. 10,000 per month to Rs. 15,000 per month for the coverage of employees under the ESI Scheme. This decision was made during the 149th meeting held on Friday under the chairmanship of Union Minister of Labour and Employment, Mallikarjun Kharge. Union Minister of State for Labour and Employment, Harish Rawat, and the vice-chairman of ESIC were also present at the meeting.

Please find attached the notification of the ESIC coverage limit increased from Rs. 10,000 per month to Rs. 15,000 per month.

I am sure the present ESI ceiling is only Rs. 10,000 and it will increase from Rs. 10,000 to Rs. 15,000 upon publication in the Gazette with a subsequent press note from the ESI Regional Office, New Delhi. For reference, please see the earlier amendment.

Could you please provide me with a solution to my problem? I am confused about whether the amount calculated in PF A/c no. 21 is based on pension fund wages or PF wages.

This confusion has arisen because I am currently working with a colleague who calculates the amount in A/c no. 21 based on PF wages, which I believe is incorrect. I would appreciate your valuable feedback on this matter.

I have a doubt regarding the ESI applicability. Is the ESI scheme applicable to a family member who is already covered under the same scheme by one of the spouses? Is it necessary even for the second person?

Dear Inna Reddy,

Yes, it is mandatory for the second person to contribute as well because ESIC provides facilities for every eligible individual, and every covered person is liable to pay the contribution.
