Are 10-Hour Shifts Legal in IT/BPO Without Overtime? Seeking Advice on Labor Laws

I invite the forum and all members to provide me with information about: What should be the exact working hours for any BPO/IT companies? Can we keep 10 hours daily (inclusive of half-hour break) and for 5 days a week without involving any overtime payments?

All your information from the knowledgeable group/forum counts very much for me while dealing with the Govt. Labor Dept., particularly in dealing with the Shops and Establishment Act, Minimum Wages Act, etc.

Dear Divyang,

You can't ask an employee to work more than 48 hours in a week and more than eight hours per day. In your case, there will be a breach of law relating to overtime in either case.

Thanks for sharing. I still do not understand; it is still less than 48 hours of working in a week as 10 hours per day x 5 working days = 50 hours less 30 minutes break for 5 working days = 2.5 hours, so it still comes to 47.5 hours. Is it not okay? Please suggest.

Can someone provide a specific and lawful website published by the Indian government where one can cross-check and validate if the working hours on a given day are not to exceed more than 8 hours and 48 hours a week? Besides 8 working hours a day, also include breaks.

We currently are facing a violation of the same in our organization (it's a global BPO and among the top 3 BPOs in Gurgaon) and have to work 9 hours, including a one-hour break. Besides, there is speculation of working hours extending to 10 hours, including a one-hour break. This seems to be a clear-cut violation where we say 8 working hours a day with 30/45 minutes of break is the labor law. Please assist and provide details on specific documents/books/Indian Government website.

Understanding Employee Rights and Policies in BPOs

My name is Sunny. I'm working with a BPO as a travel consultant. I am very confused about the rights and laws for a BPO employee. In my company, the policies are quite different. They are deducting the salary for two days if a person is absent one day without approval. Even if an employee is absent on a festival without information, the company deducts the salary for four days. If a person exceeds the break by only one minute, the company records a half-day deduction for that minute. My company does not follow any Indian leave policy, and as it is a UK-based company, they also do not allow leaves as per UK policy. They are compelling us to work for six days a week.

So, please tell me if these policies are in line with the rules or not. If not, kindly inform me about the policies as per the law and also guide me on how to resolve this problem.

As per Indian working regulations for the BPO category, is the 48-hour workweek inclusive of lunch break hours or exclusive of lunch break hours? Please help.
