In case of the death of an employee due to a fatal accident, the employee is paid as follows: average salary of the last 12 months x 50% x relevant factor. This is a normal scenario. I need clarification on the following:

- What is the calculation of monthly salary/wages?
- Which components of the total salary are included in calculating the monthly salary?
- Government employees do have a pay band, e.g., in a scale of Rs 11250-700-18950-eb-700-21750-750-22500. What does this mean?
- If over a period of time an employee earns more salary than the pay scale due to revisions (like the sixth pay commission), should the monthly salary for compensation calculation (in case of death) be considered as the drawn salary or the salary as mentioned in the scale?
- Please provide information on where I can locate the answer for this query in the law, along with your opinion on the above topic. Also, attach the latest copy of details of the act.
