Insights on Labour Court Rules, Employee Rights, and Legal Procedures in Workplace

raviswaminathanerd
Hi,

I am a Senior Manager in an outsourcing company, and we have terminated some employees since the project was closed. Sufficient notice was provided to all employees. One of the individuals has taken the matter to the Labour court, and currently, the case is with the Conciliation Officer. He mentions that if he submits a failure report, the company will be required to deposit 50% of the ex-employee's claim with the Court. I would like to confirm if this rule exists.

Additionally, I have the following questions:
1. Does the BPO industry fall under Labour Rules?
2. As he was a Team Leader (TL) in our company, does he come under Labour Law?

I would appreciate it if you could provide me with the necessary details.

Thank you.

Mr. Ravi,

Don't waste time and immediately appoint a lawyer who has mastery over labor issues. Don't listen to anyone, especially to the man who has complained against you. Keep this man as far away from you and the company as possible. Issue standing orders to reception and employees, warning them not to discuss company issues with him, or else they will be tried under your company's confidentiality agreement.

All the best.

Regards,
Ukmitra

PS: What you heard can be contested, but it is also true. Don't let your company suffer by making delayed decisions. Act fast and decisively.

Worked in a company and have now moved. But they are denying me a relieving letter, FnF statement, salaries for the worked month as the company had no funds, and reimbursements which include DA and tickets when sent on a project.

Avika, could you please email me your details at isha_mrce2008@yahoo.co.in?

I need urgent support as they have harassed my family as well with abusive words.

Hi, I'm Ankita. I worked with an AdWords selling company as a Business Development Manager for 8 months. There were more than 700 employees working with this company at different locations. On December 11, 2014, our company owner shut down the company without prior information and without paying our salaries for 45 days. The owner is planning to open another company. He has financial power, so I believe he intends to declare bankruptcy to avoid legal consequences and evade any liabilities.

I want to file a case against this company and seek justice. I need guidance on the complete procedure for this legal action. The owner of the company was well aware of the potential labor court cases that would arise from closing the company, and he seems prepared to handle them.

If anyone can provide guidance on how to proceed effectively to win this case, please advise. I would greatly appreciate any help in this matter.

Hi,

My name is Manpreet Singh, and I am currently employed at a reputed company through a third-party payroll. Some time ago, I faced a medical issue and was admitted to the hospital. After being discharged, I submitted my original medical bills to the third-party company and requested urgent resolution. However, after some time, the company representative contacted me again, asking for my medical bills and additional documents. When I inquired about this matter, they informed me that some bills were misplaced and requested the original bills to be resubmitted. Unfortunately, I did not have any original bills as the hospital only provided me with a hard copy. I resubmitted this to the company but have not received any response. Despite numerous attempts to contact them via phone calls and emails, there has been no reply. The third-party company has ceased operations at my workplace without settling their pending bills. Could you please advise me on what steps I can take in this situation?

Thank you.
