How Should We Handle a Male Employee's Aggression Towards a Female Trainee?

In my organization, we have a female trainee who has come to do a project. While she was collecting data, a male employee knocked her on the head for no reason. The girl cried out of pain. Should we report it to our manager? What should we do now? The girl never speaks to that guy anymore. He is so rude; he beats all the girls in the organization. However, that guy has 2 years of experience in the organization. Will the manager take any action? Please help.

It seems as if you are working in a company located in a place where there is no law and order or democracy. Otherwise, why would all the females in the organization endure mistreatment from this so-called male employee of the organization? Kindly try to address realistic issues. I'm really amazed and at a loss for words at the incident! It's really hard to believe as to how and WHY such violent activities are being tolerated by the company, and if it has really happened! Nonetheless, in spite of knowing the facts, why is he still with the company? He is not only dangerous to others but to himself as well. All experience and qualifications go in vain if one is unable to work as per standards, and being abusive or violent is a strict "No-No"! What brand image is this kind of employee going to reflect in the market, and what kind of culture prevails in the company that even after such incidents, no one has raised an alarm or issued a warning to him? If such incidents have occurred in the past too without any action, then I wonder what the top management is doing to prevent it. Please take stern action immediately, involve the management, and take proper action before it's too late.

I guess that fellow is suffering from some mental disorder or may be a psycho. Why would anyone beat anybody without any reason? Really disgusting. As an HR person, give him a strict warning letter that may lead to termination as well.

You have mentioned that he is an experienced person, so please try to find out his behavior from the day he joined your company. If he is beating others every now and then, then seriously, he needs medical treatment after termination from your organization.

And don't worry about terminating an experienced person; nowadays, many experienced individuals are waiting for jobs. You can replace him very soon.

This matter is really serious. First of all, encourage all the affected employees to submit a written complaint against the man. The complaint should be very specific, with details of the incident. The complaint should also include his overall behavior pattern, but note that this shouldn't overshadow the incident. This letter should be addressed to the Senior HR manager or the Head of HR, with a CC to CEO / Head of the Branch, etc.

In the same letter, you should mention that if suitable action is not taken against the person within 45 to 60 days, then I would file a complaint with the "Women Commission."

Ideally, after receiving such a complaint or complaints, the management should issue a show-cause notice to the employee.

Such matters take a long time to resolve, and the person or group complaining should stay together, have meetings regularly on the issue, and motivate each other.

You say that the Manager does not like the girl... so no point of her informing him, right? You have also mentioned that this guy knocks other girls too on their head. What about their complaints?

Anyhow - had I been in this girl's place (forget whether I am an HR or not), irrespective of my role, I would clearly ask the guy, "What is he thinking?" I would ask him to explain his behavior, apologize, and ensure that he NEVER EVER even raises his eyebrows harshly at me, or hear that from another girl in the company that he did something like that. Unless that woman is his wife...

Physical injury need not wait for information and advice from a Manager. That "SHOULD" be informed, but until some action is taken by the management, the girl can herself ask that guy not to ever behave like that.

Moreover - who cares whether he has 2 years of experience or not, your recruiter (or you - if you are the HR) should have better talent to identify people with more than 2 years of experience in that job, and with the added advantage of not being crazy to go around hitting women?

I would request you to go through the popular Vishakha guidelines laid down by the Supreme Court, which should be followed by every organization or institute where females are working. Punish such a guy so that he won't repeat such behavior. If he has a considerable history of such behavior, he should be terminated. No company should take such matters lightly, and employees should show awareness of their rights so that the company would be compelled to take action.

Sometimes, I really wonder why our colleagues do not speak out against these criminal activities/miscreants just out of fear of something they have created within their institution. Keeping quiet is a way of informing the miscreant that you are enabling their behavior. What you have mentioned is termed as sexual harassment. The miscreant should be punished now and immediately.

Ask the girl to just go and "SLAP" that stupid staff in front of everyone (Sorry for being rude, but couldn't stop), so that her self-pride remains intact and she is not embarrassed for the rest of her life. Make sure there are enough supporters available when she encounters this monster in your office.

My advice to the Trainee: "Complain about the miscreant to the manager immediately in writing and verbally. If he does not take action within 2 days, file a complaint at the nearest police station under the section "Sexual Harassment." This will result in both of them being behind bars and disciplinary action being initiated by the state bodies.

Take action immediately and share the outcome. If there are any problems, let me know your location, and we will provide support for you.

Sexual Harassment takes place if a person:

The girl has two remedies:
1. Go to her superiors/ HR manager/ or any person in such authority to take action.
2. She can also file an FIR against that man. She has the right to take legal action.

You can also gather other females who have suffered this similar problem; it will help strengthen your case.

I can see a clear picture - management is very weak or least interested in addressing this kind of incident, displaying unprofessional behavior. It seems that the employee in question is strong and behaves like a thug, making others afraid to speak up against him.

As this is a crime, the victim must report the incident to management in writing or through email. If management does not take any action within 24 hours, the victim should report the incident to the police. Victims who choose to report to the police must acknowledge their own status as victims and create narratives that will persuade others. Shalini, you can act as a witness in this case.

I truly hope to see him in jail. Why is this action necessary? Because if appropriate measures are not taken, he will continue to harm others.

I do not understand how a mature guy (at least by age!!!) can do such a disgusting thing. It should have definitely been brought to the notice of the management the first day the incident happened. In fact, I also wonder why the girls who were beaten up by him did not complain. Having two years of experience in the organization does not make him great or above all. Nonetheless, it highlights his irresponsibility, regardless of his position. Beating up anyone, let alone a female, is a crime, and people need to be punished for that. You cannot just let things go; that will only make them stronger and more likely to repeat it. Such people should be fired and made to attend court.

So, please go and inform the management. Also, if the management does not prioritize justice and the security of its employees, just leave that organization. It is not worth spending your time there when they themselves are least bothered.

Friend, see, this is really a shameful act done by any employee, be it a male or a female employee. It's the right of the person to have his space of dignity. If not taken seriously till now, at least it's better late than never. It's your responsibility to report it to your higher officials and get a show-cause notice issued to him. Let him have 2nd number of years of experience. If it had to happen in my organization and the act was done by the VP, I would get him issued a show-cause notice through the correct means. Probably he is taking HR of your company for granted, and it's a mistake on your HR part as well. Why didn't you address this act at the first notice? It's your fault as well.

Well, issue him a show-cause notice and let him give clarity as to why he performed this act. Also, issue a final warning letter followed by it.

I think it can be called a hostile work environment. Working environments are subject to individual definitions. For example, sexual joking, touching, and patting may be considered unwelcome sexual attention to some but not to others. The courts must obviously be very careful in rendering decisions concerning the definition of hostile environment harassment behaviors, as the danger exists that frivolous complaints will be encouraged, further straining an already overcrowded court system. Thus, the question of a reasonable definition of what constitutes a hostile work environment is an important one.

Why a Standard of Reasonableness is Necessary:

At last, I would say: "Women must not accept; she must challenge. She must not be awed by that which has been built up around her; she must reverence that woman in her which struggles for expression."

They should also file an FIR against that employee at the nearby police station. What I could suggest is when somebody is asking for a solution, please help him/her by giving a suggestion on overcoming such issues rather than commenting on what happened. This would help the person to have a discussed idea of what should be done. Again, people who give a suggestion have to think about how that would help the girl in a safer being. Any actions taken against the boy shouldn't bring down personal vengeance against the girl. Please do take it forward with all consideration in mind. Not exactly the same, but a little bit similar case happened to my friend. My friend is a fresher, and it's her first job. In the organization where she is working, her superior, who is an HR Manager, drank once during lunchtime. After coming back, he was speaking rubbish and singing songs at my friend. The next day, his superior was absent, so she made a complaint to the GM. The GM is a very nice person, but he couldn't support her; he just said he would talk with the HR Manager about that matter. The problem the GM is facing here is that the HR Manager is very knowledgeable and experienced, so replacing that person would not be beneficial for the company.

What, the HR Manager himself had drunk and came to the office?? Definitely, your company has to be an excellent place to work. That's why I asked you in my reply, was it a male employee or the manager himself. When the HR manager is unable to be a role model, there are no words to comment on his conduct. What to do with his knowledge and experience? That GM who couldn't voice out would have bought him (HR manager) a drink. So, an inseparable boozing pair, GM and Manager-HR.

Shalini, silently bearing with ruthless and indecent behavior is an encouragement to the bully in your office. All of you need to unite against such a person and take the matter to higher authorities and see that justice is done.

Basically, this kind of crime does not leave evidence or clues and is hard to prove. Be strict with that guy and give him a warning letter, so that such things can't be repeated by anyone.

There are a lot of factors to be considered, such as his age and the situation in which he acts, among others. Please don't just jump to the conclusion that the person is arrogant. I have come across some people who, while teaching or helping others, may come across as arrogant when their points don't seem to reach them, albeit with a light touch.

I think first of all, you should know what your service agreement/condition of service says about fighting or beating someone up. In my organization, we have a set of rules and actions that will be taken if any events such as this situation come up. First, give him a letter of warning if the matter is reported officially by the victim. Even if the victim does not report the case, you could still go ahead to initiate action as a deterrent to others that the workplace is no place for beating up people. In other words, a strong letter of warning after all necessary inquiries are made.
