Minimum Wages and Variable Dearness Allowance in Kerala

Minimum wages will not be revised every year, but there will be a periodical change in the variable dearness allowance. Therefore, if you want to know the minimum wages of employees in shops and commercial establishments in Kerala, you have to refer to the prevailing notification and fix the DA according to the current index number. In Kerala, unlike other states, the VDA changes every month based on the CPI.

If you are interested in knowing the current minimum wages that were notified in December 2016, please find the attachment. Also, please find the notification of minimum wages as applicable to security personnel in Kerala. Please note that this thread was started in 2009, and in 2014, I had sent an attachment of minimum wages for security personnel, which has now been replaced by the new one attached.

Whether the security guards' salary/basic has to comply with star hotel minimum wages or as per the minimum wage notification for security guards. We are having an audit point for the same. Kindly advise.

The security personnel on the rolls of the hotel shall be paid as per the scheduled employment pertaining to a star hotel. However, if these persons are under any third-party rolls, they can be paid according to the notification pertaining to security guards. In no way should the wages of your on-roll guards be less than that notified under the scheduled employment of security guards.

There are a number of scheduled employments for which separate minimum wages are fixed. Therefore, without knowing the scheduled employment, it is not possible to give a reply to your post.

The minimum wages of security personnel that I had posted were a proposal, and the final notification is attached now. Similarly, the revised minimum wages applicable to shops and commercial establishments are also attached. Please find the attachments.

I am requesting clarification regarding the final notification for Minimum Wages for Security Services 2017 in Kerala. As mentioned in the final notification, "..... and fix the date of publication of this notification in the Gazette as the date from which the revised rates shall come into force."

Sir, has this notification been published in the gazette? If so, could you please share the same information or let me know the exact date of this gazette notification.

Understanding Variable DA and Minimum Wages in Kerala

For each scheduled employment, the Government of Kerala fixes variable dearness allowances. It may be a certain amount per point of increase in the CPI above a certain point. For example, if the rate of VDA is Rs 29.40 per point of increase in the CPI over 130 points (base 1998=100), then take the present CPI. If it is 300, say for Kochi, then the VDA will be Rs 29.40 multiplied by 170 (the point of CPI over 130 points or 300 minus 130) or Rs 4998.

As long as the basic pay is always above the minimum wage + variable DA, do I need to include a salary component named DA in the payslip that is adjusted every year? If a component named DA is mandatory, can I keep it high at 25% so that periodic revision is not necessary.

NB: The basic salary itself is above the mandatory minimum wage (including DA) for the post.

So long as the total salary (excluding employer contributions to ESI, PF, and bonus) is more than the notified minimum wages, there is no need to pay DA separately.
