Hi Kumar,

When can we classify an employee as absconding, and what necessary legal actions can be taken? Please advise.

Thanks,

Hi Kumar,

Every organization will have service rules or standing orders to address such issues, and you can accordingly go ahead to initiate necessary action.

The word 'absconder' is not used in the service rules or standing orders by any of the companies, as claimed by one of the members. The term "absconder" is used for a criminal or fugitive who runs away and hides to avoid arrest or prosecution. Companies normally use the terms 'unauthorized absence' or 'absence from duty without intimation or prior permission' in their standing orders. Such employees are liable for disciplinary action as prescribed in the standing orders or as per the conditions of service rules.
