Can My Former Employer Refuse to Provide a Salary Certificate for My Home Loan Application?

Hi,
I have applied for a home loan and as documentary part I am supposed to give Form-16 for the last two financial years' i.e. 07-08 & 08-09. I have collected form-16 for 08-09. Since the tax was not getting deducted during 07-08, I had requested my previous employer to issue a Salary certificate for that particular year.
After one month of follow up, now they are saying that they are not supposed to issue the salary certificate for the left employee.
I am not sure how much is this true? Please help me on this.

Dear Nandu,

It is your right to get the salary certificate from your present employer or previous employer. Apply for the salary certificate in writing. In case they deny your request, go to the labor department of your area along with the denial letter. You have a legal right to obtain the certificate. I am sure this will help you a lot.
