Is the ESIC Limit Really Raised to 15000? Seeking Confirmation and Clarity

Dear Amit,

ESIC is yet to revise the current ceiling of Rs. 10,000 per month. The news of increasing it to Rs. 15,000 per month is false as of the current date.

No, the information is wrong. There is no change in the wage limit. The existing wage limit for coverage under the Act is Rs. 10,000 per month (with effect from 1.10.2006).

Till date, no official information has been provided regarding the change in ESIC ceiling. However, through our ESIC consultant, we have received information that there is a proposal to increase the ESIC ceiling from 10k to 15k.

It's an announcement from one concerned minister for a vote! (It's very difficult to implement without proper infrastructure). Let's wait for proper notification. As of now, ESIC people are busy with Project Panchdeep. Go to the website for more details.

No, the ceiling rate has not been revised yet. So, there is no need to worry about it until we receive the official order.

As per ESI Act, fixed gross up to Rs. 10,000/-, ESI is applicable. Till now, we haven't received the circular from the ESI Department. Maybe in the future.

Till date, there is no notification from the Government of India. Hence, one needs to check with the Labour Office.

There has been no change in the ESIC ceiling. However, there has been an amendment in PF and ESI for the physically challenged recently.

A monthly wage limit is prescribed by the Central Government for the purpose of coverage of employees/workers of the aforesaid factories or establishments. An employee has been defined under Section 2(9) of the Act and means any person employed for wages in or in connection with the work of a factory or establishment to which this Act applies. The wage ceiling is enhanced from time to time. The existing ceiling effective from 1.10.2006 is Rs. 10,000/- per month.

The wage ceiling has remained unchanged as of date, i.e., employees of covered units and establishments drawing wages up to Rs. 10,000 per month (excluding remuneration for overtime) come under the purview of the ESI Act, 1948 for multi-dimensional social security benefits.

We have heard from the ESIC offices that ESIC is planning to enhance the ESIC limit from Rs. 10,000/- to Rs. 15,000/-. However, this change has not been implemented yet. Therefore, the current ESIC limit remains at Rs. 10,000/-. There have been no changes in the ESIC limit to date.

Dear all,

Our blog is now abuzz with the news that ESIC has hiked the wage ceiling limit for coverage to ₹15,000 from ₹10,000. However, we should be aware of the following facts: The board of the corporation, in its recent meeting, recommended the above hike. This recommendation needs to be ratified by the central cabinet under Rule 50 of the ESI Act before it can be implemented. In the past, the central government has often postponed or deferred decisions on proposals related to ceiling hikes submitted by the corporation. Therefore, until the cabinet approves the proposal, we should refrain from making any decisions. Once the cabinet gives its approval, a formal notification will be released and widely communicated in the media.

In such a scenario, the tentative date from which the new rule could be implemented would logically be April 1, 2010, as this marks the beginning of a new contribution period.

ESI Corporation Approves Enhancement of Wage Ceiling Limit from Rs. 10,000/- to Rs. 15,000/-

The ESI Corporation has approved enhancing the wage ceiling from Rs. 10,000/- per month to Rs. 15,000/- per month for the coverage of employees under the ESI Scheme in its 149th Meeting held today, i.e., on 19th February 2010, under the chairmanship of Shri Mallikarjun Kharge, Union Minister of Labour and Employment. Shri Harish Rawat, Union Minister of State for Labour & Employment and Vice Chairman, ESIC, were also present in the meeting.

Keeping in view the increase in the cost of living index and recommendations of the Parliamentary Standing Committee on Labour, the Corporation increased the wage ceiling limit for coverage of employees under the ESI Scheme. This will help the Corporation provide a Social Security net to more and more employees of the Organized Sector.

The Corporation also decided to enhance the benefit rates for Permanent Disablement and Dependants' Benefit for those beneficiaries who are on the rolls of ESIC to get lifelong benefits under these two types of benefits. These benefits entitle the beneficiaries to receive a monthly amount for their whole life in the case of Disablement and Death. This has been done to compensate the beneficiaries against the erosion in the real value of these monthly benefits due to inflation.

In the meeting, the ESI Corporation also approved the Revised Estimates of ESIC for the current financial year and Budget Estimates for the year 2010-2011. An Amnesty Scheme has been approved by the Corporation for the withdrawal of criminal cases filed against Insured Persons and Employers under Sections 84, 85, and 85-A of the ESI Act, 1948, and the settlement of cases filed by the employers under Section 75 of the ESI Act. Provisions of primary and secondary medical care services in areas/districts where the existing ESI Hospitals are more than 25 km away and the population of Insured Persons is more than 25,000 in the areas have also been approved by the Corporation in today's meeting.
