Is Trainee Eligible For ELs

Dear friends/seniors
Is trainee eligible for ELs, if he had completed One year in the same organization and 240 days in a calender year and he is under the probationary period.

In my opinion, Factories Act or any other labour law in India does not discriminate regular employees or trainees with regard to leave. In this view it appears to me that Trainees are eligible for EL.

If a person is engaged as trainee as per provisions of Standing Orders then he shall be entitled to leave as applicable to his category and as mentioned in the standing orders only. Similarly, an apprentice engaged as per Apprentice Act is also not eligible for Earned Leave though Casual leave is permitted.
