Eligibility for Earned Leaves: Can Trainees on Probation Get ELs After a Year?

Dear friends/seniors,

Is a trainee eligible for ELs if they have completed one year in the same organization and 240 days in a calendar year while still under the probationary period?

In my opinion, the Factories Act or any other labor law in India does not discriminate against regular employees or trainees regarding leave. Therefore, it appears to me that trainees are eligible for earned leave.

If a person is engaged as a trainee as per the provisions of the Standing Orders, then he shall be entitled to leave as applicable to his category and as mentioned in the standing orders only. Similarly, an apprentice engaged as per the Apprentice Act is also not eligible for Earned Leave, though Casual Leave is permitted.
