What Documents Does an Inspector of Factories Check for a 250-Employee Company?

Dear Friends,

Can you kindly tell me what statutory documents an Inspector of Factories would generally review? We have a workforce of approximately 250 employees.

This is a bit urgent, and I would need all documents from A to Z.

Almost every inspector of factories will concentrate on health, safety, and welfare measures and registers under the Factories Act.

If you want A to Z urgently, you will get nothing. Read a good book on the Factories Act. (Recommended authors - P L Malik / H L Kumar). Understand the requirements and see the list of records and registers annexed. Maintain them! Main registers are: Factory Licence, Attendance muster, Identity Card, Notice of working hours, Register of accidents, Register of overtime, Medical records (if applicable), to name a few. You may consider hiring a consultant.

Generally, the factory inspector inspects the factory environment. Your employment details should be registered (Form-XII), including your current paid wage sheet, wage rate under the Minimum Wages Act 1967, working hours, overtime register, HSE, and similar details.

For the inspector of factories, inspect the following documents:

- Factory Licence
- Attendance muster
- Leave register
- Contract labour muster rolls and leave record
- Identity Card
- Notice of working hours
- Register of accidents
- Register of overtime
- Medical records (if applicable)

If inspecting the premises, he will verify:

- Plan approvals
- Canteen
- Creche (if women employees are more than 25)

The basic records that an Inspector of Factories will ask for are:

1. Approved factory Plans approved by the Chief Inspector of Factories
2. Valid factory Licence
3. Attendance Register
4. Leave register
5. Accident Register
6. Whitewashing & Lime Washing Register
7. Register of Fines
8. Wages Register
9. Register of Adult Workers
10. First Aid Box, Dispensary
11. Drinking Water Certificate
12. OT Register
13. Register of Dangerous Operations
14. Safety Precautions safety Guards and fencing etc. on Motors, Compressors, etc.
15. Separate Urinals/Bathrooms for males & females
16. First Aid Certificates from authorised agencies St. Johns Ambulance.
17. Canteen, Rest Room
18. Creches if there are 30 or more female workers
19. Inspection Book
20. Record of compliance of earlier Inspection report, if any.

Offhand, I can only think of the above records which the Inspector is likely to ask for. But be sure, you can never be 100% compliant.

There's always a large fee involved if you want a clean inspection report.

Else, you can be sure that there will be a fairly long list of non-compliance.

For example, "Spittoon not in the right place" is considered non-compliance. Now the Factories Act does not specify what the right place is.

Incidentally, the Inspector is now called the Assistant Director of Factories.

You cannot fight this evil; you have to live with it.
