We are dealing in the hospitality industry and I require advice pertaining to the acceptance letter of one of our employees from his previous company.
This employee was earlier working in company A where he quit. Four months later, he joined our company.
In our company, we require a copy of the acceptance letter of resignation to be submitted or the experience certificate. The problem is that company A is not willing to give a copy of the acceptance letter as per their company policy; they are not allowed to provide this document (this is as per the previous reporting manager of the employee).
I spoke to the employee's reporting manager; the employee has been given a good reference by his reporting manager. However, the manager refuses to give the copy of the letter. He is not willing to let HR to HR talk as he says he too is a concerned authority. He says we could go over and see all the documentation, but he is not willing to give us a copy. What does one do in this case? Where this documentation is required at our end and where the previous company refuses to give this documentation.
