Facing Legal Trouble After Resignation Due to Harassment: Can You Move On?

Hi,

One of my friends, who is working in an organization, resigned from his post due to harassment in the office. The resignation was accepted by the HR. After one month, due to some problem, the company wants to file a case against that employee since they don't want to lose him.

Is there any way to come out of that case and work somewhere else?

If the company really wants the employee back, they don't file any case, please understand. Check with your friend, is there any mistake or mischief done by him/her?

To come out from this case means, you have to discuss with the company or fight with them. Your friend has already submitted resignation, and it has been approved by their HR. If he has proof of this, he can work anywhere. But make sure he or she might not have committed any mistake or fraud, etc., in the company.

If an employee submits their resignation letter but the company has not relieved them on time, and the employee also chooses to stay without retracting the resignation letter, will the resignation still be effective? Will the company relieve the employee whenever it deems necessary?

Hi A.P. Singh,

First of all, make it clear whether or not you are interested in working in the revised department. If yes, then there is no problem. If not, simply resign and join a new one.

If you want to work but only in the previous department, then first check the reasons why they changed your department. After that, request to cancel that change and allow you to work in the previous department only. Have a soft conversation with your HR/RM or whoever is concerned.
