A workman of a PSU was terminated from his services due to remaining absent from his work. Under the provisions contained in the standing orders of the company, an appeal against the order of termination was presented to the appellate authority. The appellate authority had not responded in accordance with the standing orders of the company, which state that the appeal shall be disposed of within a specific period. The appeal was within limitations. An issue over the wrongful termination of services was raised before the Hon'ble ALC, who is insisting that the issue cannot be proceeded further until the disposal of the appeal by the concerned authority. Needless to state that we cannot force the authority to dispose of the appeal. Kindly suggest remedies.
