How Can I Handle My Employer's Refusal to Pay and Alleged Harassment? Seeking Urgent Advice

I need help and guidance. I am describing the complete case. Please take some time to read and provide a solution.

I have joined a CAT C level Pvt. Ltd. company two months ago as an Assistant Manager of projects. I received my salary for the first month (20 days), but the employer is now refusing to pay my salary for the last month. When I followed up, they tried to mentally harass me by transferring me to Kerala. I accepted the charge in Kerala, but on the same day, the HR head called me and said I would not receive my salary. I discussed the situation with the national HR and Admin head, and they also instructed me to surrender the company belongings, i.e., laptop and data card. I complied, but then they changed their stance and demanded my immediate resignation. I refused to resign until I receive my salary and settle other matters.

Meanwhile, they issued me a show cause notice yesterday citing reasons for: 1) Non-development of business. 2) Non-recovery of billings from clients. 3) Non-punctuality. 4) Blame: Allegedly colluding with a contractor to lock the office. In reality, the contractors took this action due to their own pending payments from the company. 5) Poor performance. (Before receiving the notice, I had sent emails to my employer detailing the harassment I was facing and the lack of support from them.)

I have invested my time, effort, and knowledge in the company, and I want to recover my salary at the very least. If possible, I also wish to teach the employer a lesson by recovering three months' salary in lieu of the notice period (as per the confirmed employment letter with this clause).

Please, please, please guide me immediately.

It's sad to see things like this. In my opinion, you have two options ahead of you:

1. Fight it out with this company. They will eat up your time, energy, and money. Even if you file a case in court, it will consume more money, and we all know the status of the judicial system.

2. Let it go and move on with your life. I know it's easier said than done, but consider moving on. Don't waste your time on getting stuff back from them; it is not going to happen. Look for a job elsewhere and move on.

But it's a choice and one that can only be made by you.

Thank you for taking the time and providing suggestions. I am also considering the second option. However, part of me is hesitant as I have invested time, effort, and knowledge into those people. It is difficult for me to let go of any part of my hard work. I am open to better suggestions if anyone has one. Thanks again.

Dear HR Recruiter,

Thank you very much for understanding my problem. You have provided excellent suggestions to make their actions known to the entire community, and the precise term you used for them is "unethical." They have now issued me a notice stating that I have not returned company property like a computer or site master (a high-value item) which was never in my possession. I want to recover the money for my hard work and effort.

Kindly advise me on the best approach to inform more people about these unethical, dishonest, and deceitful individuals.

You have a professional email coming to your inbox. Then an anonymous identity has been created to post this incident along with the company employer and management identity to everyone, and if possible, on the net too. Don't bother yourself too much; there are many companies that do things like this, like one in Goa and the so-called "filthy giants" from Delhi. Take care.

Yes. Some of the companies are doing this. The only thing they want is your resignation because they are not paying and are harassing. Please do not waste any more time. Quit the job and search for a good company.
