Regarding Signature On Epf Form N. 19 & 10c - DOC Download

Dear All,

I worked with an organization from June 2008 to 25th May 2009, and I cleared the exit formalities from the company in accordance with the rules and regulations by providing one month's notice.

I sent my EPF withdrawal forms No. 19 and 10c via Registered Post No. 3028 dated 23/9/2009 for signature and submission to the concerned Employee Provident Fund Authority office. However, they have not signed my EPF Form No. 19 and 10c.

Despite making regular calls and sending multiple emails, I have received a response stating that the forms remain unsigned to date.

Kindly advise me on what steps to take in this situation.

Hi Alok & Chethan,

Ask them the reason for not signing your forms. It's their duty to sign those forms. If not, you can even transfer your PF amount to the current PF Account.

Dear Alok & Chetan,

Please forward your forms to the EPF enforcement officer with an application stating that the company authorities are not signing the EPF forms. Visit the EPF office.

If no reply, just send a mail stating that I am directly going to meet the PF Enforcement Officer as well as Commissioner. Even then, if there is no reply, just go and meet the persons.

Dear Sir,

If the employer is not willing to sign your 19c and 10c settlement forms for any of their own reasons, you can download the 19c, 10c, and 10d forms from the website or get the signature directly from any of the local gazetted authorities/officers (from ward member to municipal chairman, MLA, MP level, and other officials) and send it to the Regional PF Office. Otherwise, you can just get in touch with the local PF Enforcement officer regarding this. He will assist you in this regard.

Please write an email detailing your work history and send it to your former company, cc'ing the local EPFO.

Dear,

If you find it difficult to get a signature from your employer, you can also have it attested by an MP, Bank manager of your bank, or any gazetted officer. Simply explain the genuine reason to them and provide the necessary evidence.

Please do not worry. You can also obtain the signature from the bank manager where you are maintaining your accounts. I am attaching the details provided by the EPF for your information.

What is the procedure to be followed by the member if the employer is not attesting his claim forms? It is the duty of the employer under the Act and Scheme to assist the Employees' Provident Fund organization in settling the Provident Fund dues of their employees. The employer must complete the prescribed application within five days of receipt (para 72(5)) and hand it over to the member when they leave the service. If a member encounters difficulty in getting the form attested by the employer, they can seek attestation from any of the following officers and send it to the Provident Fund office:

1. Manager of a bank.
2. Any gazetted officer.
3. Member of the Central Board of Trustees/committee/Regional Committee (Employees' Provident Fund Organization).
4. Magistrate/Post/Sub Post Master/President of Village Panchayat/Notary Public.

Dear Alok,

It's very easy. Complete your Form 19 and Form 10C in all respects along with a copy of all written communications, and send them to RPFC. They will get it signed by your employer. It is the employer's responsibility to write to your employer; otherwise, the employer may be contacted by RPFC for clarification. They will inform you that no one can stop the payment which falls under the social security scheme.
