Creating a Paternity Leave Policy: What Are the IT Industry Standards?

Hi. I am in the process of making a Maternity and Paternity leave policy for our organization. Can anyone help me with what the Paternity leave policy is in the IT industry?

Hi,

There are a few PSUs and corporate offices that draft flexible leave policies for their staff. Here, employees are entitled to take 2 weeks of paternity leave (paid leave).

Hi,

There is no law stating that paternity leave should be given to an employee, but many big corporations are offering up to one week of paid leave as paternity leave. It varies for each organization. Unlike maternity leave, there is no hard and fast rule for paternity leave.

Paternity Leave

A male employee with fewer than two surviving children may be granted Paternity Leave for a period of 15 days during the confinement of his wife. During the period of such leave, he shall be paid leave salary equal to the pay drawn immediately before proceeding on leave. Paternity Leave shall not be debited against the leave account and may be combined with other kinds of leave as in the case of Maternity Leave.

In NTPC, paternity leave is granted to a married employee for up to two children for one week. As a matter of policy, these provisions are for employee welfare. It is better to have uniformity compared to the provisions in the same type of industry. I think there should be a penalty when a third child is born, and the paternity leave granted earlier should be converted to leave without pay, resulting in a break in service - as a matter of policy. The Unions must be taken into confidence before implementing this change. Population explosion needs to be halted, as it is consuming all the additional resources being created, such as housing, food items, and so on. PROSPERITY COMES WITH DISCIPLINE.

Hi,

Paternity leave may be availed for up to 5 days by married male employees with fewer than two children. Maternity leave consists of 12 weeks off for all married female employees with fewer than 2 children. In the case of a miscarriage, 6 weeks of leave is allowed. These are paid leaves but are not encashable.

Hi,

Is there any labor law governing the grant of paternity leave? If so, could anyone post the relevant portion of the law? Also, could you clarify if this leave needs to be granted while the wife is confined or admitted for maternity? Can this leave be availed after a couple of months of delivery, that is, can this leave be carried forward for later availing?

Paternity leave may be granted to a male staff member with fewer than two surviving children, for a period of 15 days during the confinement of his wife. During the period of such leave, he shall be paid leave salary equal to the pay drawn before proceeding on leave. Paternity leave shall not be debited against the leave account and may be combined with any other kind of leave. It may not normally be refused under any circumstances.

Hi,

There is no law in India pertaining to or supporting Paternity leave. It is the sole discretion of the company to have a clause in the leave policy for this. Yes, if the company allows the clause in the appointment letter, then he may be allowed 1-2 weeks of paid leave depending upon the policy clause.
