Employee Refuses Relocation: How Should We Handle Termination?

Dear Friend,

One of our employees is not ready to move to the location allocated by our company. As per his offer and appointment letter, it is very clear that he should be ready to move anywhere in India. Please help me by providing a termination letter in such a case.

Though the appointment order provides for transfer of service, before terminating his service, he shall be given an opportunity of being heard. Therefore, send him a letter stating that he has misconducted by not complying with the rules of the company or terms of the appointing order when directed to take charge at another station, and he is likely to be terminated. You can also give him an opportunity to show cause why his services should not be terminated. If the explanation is not acceptable, then you can terminate him. If you terminate without even giving him an opportunity to be heard, the termination may not sustain.
