Navigating Accident Claims: Can New Employees Get Benefits from Both ESIC and PF?

Dear sir,

Kindly guide me on how I can settle the claim if someone meets with an accident on their first day of employment in any industry. Is it possible to provide them with accident benefits from both ESIC and PF?

Dear Santhosh,

If the employee met with an accident on the day of joining itself, FIRST GIVE HIM FIRST AID FROM/ ADMIT HIM FOR TREATMENT IN THE NEAREST PRIVATE HOSPITAL OR DISPENSARY.

1. You can get the declaration form under ESIC filled in and affix a photo with the help of his biodata/personal file details.

2. Fill up the accident form in Form 16 in duplicate copy, duly signed by the manager/authorized signatory under ESIC.

3. Take both the forms to the local ESIC office and meet the manager; he will provide you an ESIC identity card for the employee immediately.

4. With that, you can contact the nearest ESIC hospital for the necessary pick up of him for treatment to the ESIC hospital from the hospital where he was earlier admitted.

5. If the injury is normal, where there is no admission in the hospital is required, hand over the ESIC card to him for the continuation of medicine/treatment in the ESIC dispensary allotted to him.

ALL THE THINGS SHOULD BE DONE WITHIN 24 HOURS.

(Also, please note that if you are coming under the Factories Act, the Accident Report in Form 18 is to be sent to the factory inspectorate immediately within 48 hours)

Necessary details are to be filled in the Accident Register under the ESIC Act and Factories Act.
