Are Casual Workers in Hotels Missing Out on PF and ESI Benefits? Let's Discuss Their Rights

Are casual workers entitled to PF, ESI, or any other benefits in the hotel industry? Please note that these casual workers do not figure in our muster rolls, and the voucher payments made to them are accounted for as some other extra expenses and not payments made to casual workers.

In our hotel, casual workers are as good as invisible workers as no benefits are given to them, no appointment/hiring letter has been issued to them. Please advise.

How have you recruited these people? How do they show up for work every day? The actual answer is dependent on that.

As per the law, whatever the organization - hotel or any other organization - if any type of worker is doing any job on our premises, it is our responsibility to cover him or her under all these acts. This coverage may be provided by a contractor or by your company only, but it must be provided.

Hi,

As Rajesh said, they must converge under the Contract Labour Act. But, I think he forgot to tell you that, As per the Contract Labour Act, casual workers should be worked under any contractor. Secondly, if contract workers are 20 or more than the same, you have to register under the said act. But if not, it is not mandatory to register.

If the casual workers are working at your premises and they are not under any contractor, you have to pay the ESIC contribution. PF and other facilities depend on other situations. But ESIC contribution has to be done, or you have to provide health insurance to them.
