Employee Left Without Notice: Can They Still Get Their Full PF or Transfer It?

jagruti02
Hi,

If an employee leaves the organization without serving any notice and joins somewhere else, will he/she receive the full PF amount from the previous employer, or is it possible to transfer the PF account?

Please let me know.

Hi,

1) Employees can withdraw the PF accumulations by filling out Forms 19 and 10 C.
2) Form No. 19 is for Provident Fund withdrawal, and Form No. 10 C is for Pension Scheme withdrawal.
3) Form No. 13 is used to transfer your P.F. amount.

Please let me know if you need any further assistance.

If your exit from the old company is not good, then they won't be signing the 19 and 10C forms, which are mandatory. For these forms, you have the only chance of transferring your PF amount to your new PF account (using Form 13). For this, you must know your old PF account number.

Hi Lavanya,

Can he withdraw this PF amount while still working in the organization?

Hi Lavanya,

A member can withdraw the full amount standing to his credit in the Provident Fund:

A) IMMEDIATELY

(i) On retirement from service or termination from service

(ii) On retirement on account of permanent and total incapacity for work due to bodily or mental infirmity

(iii) Before migration from India for permanent settlement abroad or for taking employment abroad.

(iv) On termination of service in case of mass or individual retrenchment

(v) In case of a female member resigning from the service of the establishment for the purpose of getting married

B) The payment shall be made only after completing a continuous period of not less than 2 months immediately preceding the date on which a member makes the application for withdrawal in the following cases:

(i) Where a factory or establishment is closed but certain employees who are not retrenched are transferred by the employer to another factory or establishment not covered under the EPF Act.

(ii) Where a member is transferred from a covered factory or establishment to another factory or establishment not covered under the EPF Act but is under the same employer.

(iii) Where a member is discharged and is given retrenchment compensation under the Industrial Disputes Act, 1947.

I left the company 1 year ago and started my business. I don't think my company will sign any form. Can I withdraw my PF directly from the PF office?

Hi, I want to know if there is a time limit until when an ex-employee will get the PF. I mean, suppose a female employee changed office and name after marriage; hence, the transfer could not take place. So, in that case, after 2-3 years, can she get the PF from her previous employers?

Dear Jag,

He/she will transfer or withdraw the full amount. If any employee leaves the organization without serving any notice and joins somewhere else, will he/she be getting the full PF amount from the previous employer, or is it possible to transfer the PF account? Please let me know.

Hi,

If a person leaves without informing you, the PF department cannot control his actions. He can withdraw by applying in Form 19 & 10C. In the place where the employer's signature is required, he may get the bank manager's signature as this option is available and apply. In case he wants to transfer to the new company, he can apply through the new company using Form 13.

If a person does not know his PF account number, he can visit the PF office concerned where his company's files are maintained, meet the case worker, and try to get the account number. If the PF records are not updated, then he may have to revert back to his employer for his PF account number.

Instead of running away from the job and undergoing all these hassles to get the PF money - would it not be ideal for one to follow the procedures in a company and come out with a clear mind and get the company's assistance in getting his PF money too? Is all this acrobatics worth it? Before thinking of these options of running away, it's better first to find out about the provisions of law that one is trying to break. Maybe the cost of following company rules would be less than the cost of effort for getting PF money without the company's assistance/boss's signature. Think it over.
