Understanding Non-Contribution Periods: How Do They Affect Part-Time Employees?

If an employee worked for 15 days in a month, the remaining days come under the non-contribution period. If an employee did not work for certain months, that falls under the NCP. I just have confusion regarding NCP. Please clarify.

This will also be a non-contribution period. If the salary is prepared and given, then PF will be deducted; otherwise, not.

How will it be calculated? Actually, we will calculate this NCP at the time of PF withdrawal submission. For an employee who has worked for a long period of time but has been absent 1 or 2 days every month due to not having any leave balance, it is critical to calculate the NCL. Will it only show on the last contribution period? Please clarify.

LOP will come under the non-contribution of PF. It is simple; working days only require to be calculated.

Is it necessary to show on Form 19 as NCL if he was absent for 1 or 2 months and then rejoined the organization? In Form 19, which NCL will be shown for withdrawal of PF?

I had been contributing to PF for 33 years. I went abroad for a year, out of which 9 months were with pay, and the remaining 3 were without pay. So, there was no contribution for 3 months. When I came back, due to a change in circumstances and work environment, I had to resign after 2 months. I opted for a revision of the pension and paid roughly Rs 600,000/-. To my utter surprise, I got only Rs 5900/- as pension while my colleagues with similar service got Rs 11500/-. On checking, I was told that even though there was not a single day's non-contributory period, because of the last 3 months NCP, it has been reduced. I was also informed that had I resigned without joining, it would not have affected my pension. I don't understand the logic. Can anyone shed light on this as to how it can be rectified? I would appreciate it if any case laws are cited in this regard.
