Workmen's Compensation Dilemma: Should Insurance Cover This Medical Expense?

In our company, one workman met an accident, and accordingly, we have admitted him to the medical facility for treatment. Now, the doctor has advised that the person needs an operation, and for that purpose, around $40,000 will need to be expended. Our company has agreed to cover the expenses. Please note that we have workmen's compensation policy.

So, my query is whether the medical expenses should be borne by the insurance company under the workmen's compensation policy, or if there is any other method to recover the same.

You have to explain what type of policy you have, whether it covers medical expenses or not. You have to study your policy; only then can you get the answer. How can others reply to your question when they do not know the coverage of your policy?

Dear Sir/Madam,

We are a contractor and have a workers' compensation policy for our client's site, where one of our personnel passed away. Consequently, the principal employer/client has deducted 4 lakhs without our consent. Moreover, the insurance company has rejected the claims due to a negative FIR report filed at the client's site. The deceased individual was a resident of outside India, and their family could not claim. The factory inspector has also submitted his report.

Could you please explain how we can receive our payment from the Workers' Compensation Commissioner? Should we engage a lawyer/ workers' compensation expert, or should we directly follow up with the client/principal employer? Your guidance on this matter would be greatly appreciated.
