Actually, this provision is being misused by some employers in the case of resigned workers. Recently, I came to know about such incidents. Some of my friends have left an organization and joined a new one. Now, when they submit their PF withdrawal request, two of them got their forms duly signed by their ex-employer. However, the ex-employer's company refused to approve the PF claim for the remaining two employees because the company was not willing to relieve them, as they were providing good service for a low salary. Nevertheless, they left, and the company acted in a prejudiced manner. The ex-employer rejected the PF withdrawal forms of these employees on the grounds that they were already in a job that is a member of the PF scheme, and thus, these employees had given false declarations in this regard. Surprisingly, this fact was true for all four employees, and the ex-employer was already aware of it. However, they cleared the PF withdrawal of two employees without any objection!
I helped both employees, and they have successfully withdrawn their money now. This incident leads to the impression of how even MNC companies can adopt such an unprofessional approach.
