Confused About Minimum Wages for Contract Workers in UP? Let's Clarify Together

The company in which I am employed is a Central Govt. Co. located in Uttar Pradesh. Contract technicians are engaged through a contractor in the factory for carrying out maintenance activities.

The latest minimum wage in UP is Rs. 164 (min. basic) + 37.54 (VDA) = 201.66/- for all 59 types of industries.

My question is: in compliance with the Minimum Wages Act, what is the minimum wage that is to be paid to contract employees, i.e. 164/- or 201/-?

Yes, you have to pay the $200 plus as per the minimum wages prescribed in the gazette every year based on the revision. There are no other alternatives in this regard.

Minimum Wage = Basic + DA (if you have mentioned the right figure of min. basic and DA of U.P.) then it should be = Rs. 164 + 37.54 = 201.66.

The total of all components, taken into consideration, for the formulation of Minimum Wages for a particular category of workers will have to be paid to the workers. In the given case, the Minimum Wages should be Rs. 201.66 per worker, per day (of eight working hours). The contractor will have to be paid accordingly.

Hi, good morning!

Just clarifying here that you have to pay Basic+DA in U.P., but not to all Rs. 201.66; it should be according to the category of the employees, i.e., Unskilled, Semiskilled, and Skilled. The minimum wages for these categories are Rs. 129.70 per day for Unskilled, Rs. 147.85 per day for Semiskilled, and Rs. 164.10 per day for Skilled employees from 01-04-2009 to 30-09-2009. Basically, minimum wages consist of Basic & DA, so it would be Rs201.66 in this case.

Dear Deepak,

Kindly let me know, what you are doing or where you are working. I am also a labor laws consultant in Kanpur.

The amount of Basic and DA would be added and divided by 26. Then we get the per day salary/wages. The wages/salary would be paid to employees as per their designation, such as a peon/helper being unskilled labor. So their salary/wages are (2600 + 773) = 3373 / 26 = Rs. 129.73. You can also obtain the GO for the same from the Labor Office, Sarvodaya Nagar, Kanpur.
