Maternity Leave Benefit Clarification

sagacia
i am with a new private entity run as a family business. however as they are going for ISO certification they want me to prepare a Leave policy.
As a rule it is six weeks before and six weeks after the delivery i.e 90 days. and in 2008 the indian govt. has extended this to 180 days.[for govt. employees]
Bu my management is adamant about 3 weeks before and 3 weeks after benefits i.e 6 weeks in total.
As a private organization, are we required to follow the maternity benefits rule as per the rule for govt employees?

dear
the leave for 180 is applicable for central govt employee.
in your case maternity benefit act 1961 will apply and you are bound to give 12 weeks leave as maternity benefit in which not more than 6 weeks before delivery.
it is india and management can do whatever they want.In india we are habituted not to follow law of the land

Dear sagacia,
Great!!!!! your management is very generous and kind!!!! Tell them to be prepare for legal issue..........Penality for not following the rule of maternity ----punishable with imprisonment which may extend to one year, or with fine which may extend to five thousand rupees, or with both:
Why your organisation is giving total 6 weeks leave... tell them do not give any maternity leave....because penalty will be same for half followed rule and completely not following rule.
