Is It Right to Offer a Consolidated Salary Without P.F.? Need Urgent Advice!

sitarist
Dear Friends,

My management asked me to prepare an appointment letter with a monthly salary of Rs. 7000/- without P.F. facility. I have mentioned the salary as Consolidated Rs. 7000/- p.m. Is this correct? In this case, should I only deduct professional tax? Do I have to give a breakup? How to make a breakup and simultaneously not give any P.F.?

Can anyone reply to me urgently to my email Id, please?

Regards,
Sitarist

Your management is trying to flout the rules of the PF. The employee should be covered under the PF Act, whether it is a consolidated pay or other pay scale.

Thank you.

Hi Sitarist,

As Mr. Pon said, your management is trying to flout the PF department. Moreover, could you please tell me which state you are from? Because Professional Tax (PT) varies from state to state. In Karnataka, there is no deduction of PT up to 9999/-. Furthermore, is ESI applicable in your area?

Hi Jeeva,

Please read his query. He is asking about PF, not PT. There is no separate rule for PF for every state.

Hi Pon. I am inquiring about Professional Tax (PT) and Provident Fund (PF) rules in India. The same rule applies for PF across the country, but PT varies from state to state. It has been clearly mentioned, "Should I only deduct professional tax." This statement is specific to PT regulations. In Karnataka, there is no PT for incomes below Rs. 10,000. For example, if an employee's consolidated pay is Rs. 7,000, they are not subject to PT.

Moreover, I believe you are from Chennai. If possible, could you please provide me with the latest PT slab rates in Tamil Nadu? Previously, Tamil Nadu had the lowest slab rates for PT.
