Is It Necessary to Deduct PF for a 65-Year-Old Employee Who Prefers Otherwise?

Dear all,

I need some clarification on PF. I am an employer, and I have appointed a person aged 65 in my company. Is it mandatory to deduct PF for him as well? The employee is requesting me not to deduct PF. Please clarify.

Note: PF has been applicable to my company for the last three years.

If you are paying a basic salary of more than Rs. 6500/-, then there is no question of age coming.

There is no age limit in PF. If his basic salary is less than or up to 6500 or 60% of Gross salary up to 6500, then you are eligible for deducting PF for that person.

If you have mentioned the retirement age in the appointment letter, if not, after the age of 58 years, it is not mandatory to deduct PF.

Suggestion: He can be appointed as a consultant.

Dear Venkat Sir,

The PF wage ceiling is 6500 or less wages (i.e., Basic and DA). If that employee crossed his age of 58 years, then his salary is less than 6500, the employer should contribute the employee and employer contributions to the PF authority. However, the total contribution from the Employee (12%) and the Employer (12%) (total 24%) goes directly to the PF account only. Once the employee crosses the age of 58 years, he/she is not eligible for the Employee Pension Scheme (16-11-1995) as per the EPF (MP) Act-1952.

Excluded Employee, as defined under paragraph 2(f) of the Employees' Provident Fund Scheme, means an employee who, having been a member of the fund, has withdrawn the full amount of accumulation in the fund on retirement from service after attaining the age of 55 years. If a retired person is appointed and has withdrawn their PF before joining, there is no need to contribute to PF.

Dear All,

If you are employing an employee over the age of 58 years, then he is eligible only for PF at 12% and not the pension fund as per the ruling of the PF Act.

Dear Venkat sir,

We have deducted 12% of his basic salary. Instead of putting 3.67% on PF and 8.33% on the pension fund of the employee, we have to put 12% on the pension contribution itself instead of PF. However, this 12% deduction towards the Pension fund is mandatory.

There is no age limit to join EPF. Only the membership of the Pension Fund is limited to a person aged 58. In this case, the professor may join EPF only, and the entire amount of the employer's contribution, i.e., 12%, will go to the Provident Fund only, instead of both PF and Pension Fund.
