Stuck in a Job Bond: How Can I Resign Without a Relieving Letter?

Greetings!!!

I am in a situation where I need your expertise, please help me out. I had joined a firm 5 months ago. I am in a probation period of 6 months. They had told me about signing a bond for working with them for 2 years, on breaching I'll have to pay 2 lacs to the firm and made me sign it after my 2 months completion, which was not mentioned in my offer letter nor even in my appointment letter. I was not at all satisfied in the company and wanted to resign because of a lot of pressure and very bad treatment by the manager, although I was performing well. Now I have an opportunity from an MNC, and as per their immediate requirement, I have joined them and given my current employer a resignation letter with one month's pay. However, the company is not providing me with a relieving letter or even accepting my resignation.

Now, what should I do, and is it necessary to have the relieving letter? Please help. :(

Regarding the relieving letter, it depends on the company. They may ask you to submit it or may relieve you from this condition if your potential is really needed by the company or if it's not a mandatory requirement under HR ISO procedures or any company policy.

You have just served for 5 months there. If your current employer is not asking for the same, then keep silent.

Request for guidance:

I am working as a QA/QC Engineer for a big construction company in India. Upon joining the company, they sponsored me for the CSWIP 3.1 course (costing 80,000 INR) and asked me to sign a 1-year bond of 1 Lakh at the time of joining. The bond is signed by 1. the employee and 2. his/her parents. I personally asked the HR manager before joining if, after completing the 1-year bond, the company would provide me with the certificate. He affirmed this, based on which I joined the company.

Concern:

After completing 1 year, I resigned. However, the HR personnel are now refusing to give me the CSWIP 3.1 certificate, stating that the company has paid for it.

Query:

1. What should I do to obtain my certificate?
2. If I take this matter to court, will my case stand, and what would happen there?
