Please help me. I just want to know whether ESI is applicable to employees who are 63 years old, working for a company where ESI is applicable, and earning less than 10,000. Yes or no? It's urgent.

It's been 60 years. However, in this particular case, after his retirement, we have taken him on a fixed-period contract basis. For the last 3 years, we have been renewing the contract at the end of the year. But this time, we also have to change the unit where ESI is applicable. Please reply soon.

Sir, you do have to pay ESI contributions on salaries of Rs. 10,000 and below (excluding washing allowance). Age is not the criteria for coverage.

Yes, he has to be covered under ESI. Age is not the criterion for membership.

I need clarification. If, for example, we hire employees on a contract basis, we need to pay ESI and PF contributions. However, if we hire employees on a consolidated salary basis, what do we need to pay in terms of ESI and PF contributions?

Could you kindly indicate whether ESI and PF will be applicable or not when we hire any employee on a consolidated salary, even if their salary is Rs. 11,000?

Dear Mr. Sudhakar,

If an employee is on a contract basis and the employer convinces them to not contribute to the PF and ESI scheme, then for these employees, PF and ESI will not be applicable. Keep the basic salary more than 6500 per month so PF will not be applicable. Also, if the gross salary is more than 10000, ESI will not be applicable.

My concern is regarding the coverage of these employees under the PF authorities to avoid legal disputes. My consultant suggests that there is no necessity to cover them when they are on a consolidated salary. However, my stance is that they should be included. What is your opinion on this matter, especially for consolidated employees earning under Rs 10,000 per month?
