Stuck with PF Withdrawal Due to Employer's Refusal: How Can I Access My Funds?

I am facing an issue with withdrawing money from my PF account. A few months ago, I left the company abruptly. Consequently, the PF withdrawal form requires the signature of my previous employer, who is currently unwilling to sign the form.

Could you please advise me on how to proceed with withdrawing my money?

Dear [Recipient],

If your previous employer refuses to sign your form, you can deposit it directly at the PF office with a letter stating that your previous employer is not signing the form.

Dear Nitin,

If your previous company employer is not ready to sign the withdrawal forms, then you should approach your Regional PF office (PF Enforcement Officer) and submit the forms. It is the responsibility of the PF officer to obtain the signature from the Employer.

It's not mandatory that you get it signed by your employer. The same can be deposited to any regional office with attestation from any of the Gazetted officers, a bank manager, through a postmaster, or even through a magistrate. You should deposit it with all your bank details, duly self-attested on receiving stamp with both Form 19 & Form 10-C.

It is the duty of the employer under the Act & Scheme to help the Employees' Provident Fund Organization settle the Provident Fund dues of their employees. The employer must complete the prescribed application within 5 days of receipt [para 72(5)] forms and hand it over to the member when they leave the service.

When a member finds it difficult to get the form attested by the employer, they can get the attestation from any of the following officers and send it to the Provident Fund office:

- Manager of a bank.
- Any gazetted officer.
- Member of the Central Board of Trustees/committee/Regional Committee (Employees' Provident Fund Organization).
- Magistrate/Post/Sub Postmaster/President of Village Panchayat/Notary Public.

This is the rule by the Provident Fund Commissioner of India. If you have any doubt, visit the site of EPFO.

Hey Nitin, it seems your ex-employer hasn't filed their EPF return yet; that's why they are denied the same. Don't worry, your EPF amount is safe with the EPF office, and you can access it anytime in your life. I would suggest you wait for 1-2 months, and after that, you can sign your EPF form and submit it to the EPF office.
