Are There New ESI Rule Changes for Construction Agencies and Contract Labor?

Hi,

Could anybody provide information on any latest amendments in ESI rules for the exemption of ESI for construction agencies/establishments and contract labor working in these establishments?

Dear Tapan,

If the construction workers are employees of the construction establishments, they are coverable under the ESI Act. However, construction agencies/establishments, if they employ 20 or more employees, are coverable under the ESI Act.

Ministry of Labour & Employment had issued the Notification No. G.S.R. 164 (E) dated 20 April 2010 amending the Employees' State Insurance (Central) Rules 1950 - enhancing the wage ceiling for coverage under ESI Act 1948 from Rs. 10,000/- to Rs. 15,000/- *w.e.f 1st May 2010*
