Dear Satya,

There is no specific form for withdrawing the security deposit. You need to obtain a clearance certificate from the Principal employer and send a request letter to the labor officer along with the clearance certificate. Alternatively, you can adjust the amount against another security deposit for which Form No: 5A is required. It is very rare for the labor department to refund the security deposit amount.

Rule 31 of CL (R&A) Central Rules clearly permits the contractor to retrieve their security deposit from the labor department.

Dear Vivek,

I agree with you, but most of all, labor inspectors or labor commissioners are not ready to refund the security deposit amount because they put unnecessary queries on that.
