Struggling with PF Transfer After a Rocky Exit: Can I Still Claim My Funds?

Hi all,

Due to some personal reasons, I didn't have a smooth exit from my previous company (without a relieving letter). Also, I only worked for 10 days in my notice period. I have joined my new company a week before. If I try to opt for PF transfer or PF withdrawal, it goes to my previous employer for verification and authorization. In my case, I haven't satisfied the norms of the previous employer. Will it be possible to claim my PF amount in any other way? I heard that the employer can hold the PF account; is it true? Please provide your valuable suggestions to help me get my PF amount.

They cannot hold your PF withdrawal or transfer. PF contribution is statutory, which is monitored and controlled by the government. In case your previous employer creates a problem for you in claiming your PF, then you can file a complaint against them in the Regional PF Commissioner's office for that zone.

Hi, This is Bhaskar,

Your previous employer cannot hold your PF dues to settle, but has all the rights to hold your final settlement, where PF is a part of your final settlement. My suggestion regarding this is to please speak to your previous manager, convince them, and send them a PF withdrawal form (Form 19 and 10 C). If you want to transfer the same to your present company, then send Form 13 (which should be routed through the present employer), marking cc to the respective RPFC. This can help in getting your PF amount.

PF authorities always support employees. Hope this clarifies your doubt.

Dear GOK,

Bhaskar's advice is the best. If F-13 has already been submitted, you can approach the PF Enforcement Officer or the RPFC concerned and seek a solution. Generally, when the employer refuses to forward Form-13 or F-19, it can be forwarded through the district Tehsildar along with verification from the Patwari.

In no case can the PF amount be withheld by anybody if it has been deposited (You must have a PF Account No.).

I too agree with Bhaskar's advice. Nobody can stop your PF amount. Also, if you have a good relationship with someone senior in the organization, you can try to get the relieving/experience letter. Talk to senior management and tell them that you had a great learning experience and respect the organization. You would like to leave the company on a good note.

I always ensure that when I am leaving an organization due to personal or professional reasons, I exit on a good note and complete all the formalities. The current employer will always verify your past employment history through external/outsourced channels.

No one can hold your PF amount if you have resigned. Bhaskar has given the right suggestion. However, you'll have to resign first. You should have a resignation acceptance in case you do not have any relieving or experience letter to pursue any statutory action.
