Facing Job Termination Due to Office Politics: Can I Take Legal Action or Appeal?

I am deeply going into depression due to politics in the company. I am working in India's leading export house, but one week before management told me that your service would be terminated due to new hiring. I have joined on 23rd Feb-09 and I am still in the probation period. Please advise, could I take any legal action or request the company regarding this matter.

First, you have to be very strong, dear, if you really want to get through this situation. Make yourself emotionally very strong. Then, ask your management to provide in writing why they are letting you go, and inquire about the reasons. Please do not sign any documents without reading and understanding them properly.

Please check your appointment letter for the exit clause. In most cases, during the probation period, management has the right to end the contract without giving any reason. I suggest you talk to your management and immediate boss. Start looking for a job and have confidence in yourself. This is a common challenge. Remember not to work for a company; always work for a job. Better opportunities are waiting for you in the future.

Maybe you lack the confidence and the "Yes, I can" attitude, and that's why your boss is not happy. Why would he replace you with a new guy? Try to find out the reasons. First of all, my sympathies to you. However, please understand that while you are on probation, the company may decide to terminate your services without assigning any reasons. You have not mentioned the terms of your appointment, the duration of the probation period, or whether there is any clause preventing or permitting the management to terminate your services without giving reasons. Please carefully review the letter of appointment. If the company is adhering to what has been mentioned and agreed upon by you, there is very little you can do. Be courageous and graceful in accepting the inevitable. Ask them to provide you with a good experience certificate and request them to state the reason for leaving as "personal."

I can understand how painful this situation is for you, but in today's work life, hiring and firing are becoming common. Do not lose hope, and I am sure you will soon find something better as the markets are definitely showing signs of opening up.

Do not feel depressed. Speak to your boss to understand the reasons and explain your position. Ask them to give you a chance. If nothing works out, don't be discouraged. Try somewhere else.

Look, my seniors and friends have already suggested about the possible move. There is nothing more to say. The only thing I would say is, don't get depressed. In case you require any sort of help, you can call me on my cell whenever you wish to, which is provided below. Whatever help is possible from my side, you will definitely get it.

Export houses and almost every company are cutting costs. Export houses are particularly hard hit by the recession as import requirements are low. It is possible that they hired the new employee at a lower pay scale. In any case, you need to remain sincere and try to look for another job. There is very little point in getting depressed, although I understand that it is inevitable. What you need to focus on and understand is that 10 years down the line, the status of your life will depend on how you tackle this challenge.

Try to tackle the situation by requesting your company to provide you with at least 2 months' notice for any changes. With this advance notice, you will have ample time to search for other opportunities.

I see that there is no point in asking for your rights to continue with them anymore. But since they have terminated you, please ask them for the final settlement and keep moving.

Reasons for termination may be:
a) They found someone for a better pay.
b) OR they were desperately in need of someone for that posting of yours and did not find anyone really good at that point. They felt you were average and hired you to put the fire off. Later, they came across this new candidate who seemed to be just the right person they were looking at, and they had no choice but to hire him.
c) OR they felt it would take time and investment to train you, and they had no choice because of falling profits - but hired another person who may be much more experienced than you.

It happens not just in the export industry but across all industries.

Regarding your next job:

Please check if the company that is offering you a job has the ability to pay you the salary that fits your profile.

When you do a salary negotiation, clearly tell them that you would like the range to be within the company standards. If it's not within the company standards and if they are looking to hire you just to put out the fire at the moment, then you need to tell them that you are looking for a long-term relationship, not a short-lived one.

Depression is one thing that stops anyone from thinking forward. I don't know, it's like a symptom in which you are not able to look at the brighter side. I can't tell you to stop being depressed because I know the difficulty in coming out of it.

I have also been through major depression in my life, and I can confidently say that once you see the light and the opportunity that's waiting behind the door, one day you will turn back and see how much these incidents in life have taught us to be careful while choosing and making life's important choices. To make this door visible to your eyes, stop replaying the past in your head. Be confident - the hand that held you until now knows how to lead you forever.

Life is 10% of what happens to you and 90% of what you make out of it!

There is not any particular reason to fire me. My boss is always appreciating my work; he even told me, "you can stay here until you find another job." However, due to strong pressure from higher management, he is also feeling helpless.

I have also faced the same problem. I was working with a US-based travel company for the last 23 months in an HR profile, and it is nowhere mentioned in my appointment letter that they can ask me to leave without any reason. I was not comfortable working the Graveyard shift, i.e., 10 PM to 6:00 AM. My AM shifted me to that shift without any specific work. He also stopped my salary and incentives for the month of May '09, and my other dues like medical and incentives for the months of April, May, and June are with the company. Kindly suggest what to do.

The company has its full right to terminate, especially in times of this crisis. Yet the door for you is not closed. Shake up your daily schedule, spice it up, and accelerate. I can understand the turmoil you are going through. Don't lose heart. I know it is difficult at this stage where you might be dependent on your job for all aspects. Start applying for jobs and go for interviews with a positive attitude. Sometimes, there are very tough times, but they do not last forever. After a devastating forest fire, there is new life budding everywhere. The same goes for you. I would personally like to ask you to stay calm and try for new jobs. Most of the export houses would have their legal cells, so even if you take them to court, you will not be interrupting their day-to-day work, whereas you would be losing your time, effort, emotions, and money. Get up, stand up, and fight for a job by attending many interviews. Never badmouth your previous company, but I am sure you have learned a lesson. Stay strong, and you will shine in life.

I would like to remind you of something. In the recent past, one huge company has collapsed, and many of its employees had to leave without any choice, left in their hands. Some of them had families fully relying on their paychecks. They all moved on with life. Nothing is permanent, you see. Though it's natural to feel bad, life is all about ups and downs. Take it easy. Just look out for the right opportunity, read good books, and focus on positive thoughts.
