Can My Former Employer Legally Recover My Notice Period Salary After Resignation?

Hi,

In the offer email, my employer had mentioned that they were ready to buy back my notice period salary but would recover the same if I resigned within one year. However, there has been no mention in my appointment letter (hard copy receipt of which has been acknowledged by me). Now, since I have resigned from the company, does the company have the right to recover the amount? In my opinion, they cannot as the offer letter does not have a legal binding on both parties. Please let me know the correct stand. Also, if I need to take up the matter legally, please let me know whom to approach.

If the notice period clause is not mentioned in your offer letter or appointment letter, then, according to me, they cannot ask for notice recovery.

First, let me tell you that you are not a person of many words. Once it was decided that the company would buy back your notice pay if you serve for one year.

On what basis do we work with the company? It is on a contract basis, as mentioned in the offer letter which you have accepted.

Dear, what else do you want? You have accepted the offer, so why would it not become a legal document?

Before facing such situations, always show empathy towards your present employer. Don't forget that your present employer accepted you even before anybody else did and gave you an opportunity to work, without which you could not have become who you are today.
