PF Deductions In Employee Salary

Dear All
I need one information from your end regarding PF,
if soupose Prinicipal employer pay excess of PF(employer part) form last one year, is there any option to deduct the PF amount in the employee Salary? plz revert back me with suitable ans, its very urgent. :icon13::-?
No, Because The same amount had been deducted in his salary part also, and u will not do any types of changes in his contributions.

I agree with you but one our man power outsoucrsing agency they deduct the empolyer PF contribution in employee salary,is there any options like that?

we are giving outsource for labour compliance/Satutoury with employees, per employee 28000/- fixed(only for salary) in this amount coverd all staturtory compliance for that employee means Bonus,PF,Leave with wage,(No ESI) all over india they are depute 31 employees in all our locations, but they are paying to employees only 10000/- with PF and PT dedctions, but one sad news is our side one person also involving in this process, he as to take of bill processing and he is the top most position in our company
now tel me how to avoid this practice. and how much Percent he as to pay salary on the agreement, is there any notifiction or is there any rule ? for this

there is no rule for employees, that agreemnet for 31 employees only, and PF deduction from last 2 months

No,
there is no legality to deduct from employee salary , once employer declare the contribution is voluntary.

Dear Friend,

Employer can deduct maximum of 12% of your basic salary towards PF. If the employee and employer wish to contribute more percentage, they can do that. Employee can limit his contribution to 12% of his basic salary. If your basic is above 6500, then it is not compulsory that you should join PF.

Dear Santhu,
There is no issue in it, you can adjust it in your Annual returns. That the PF department will calculate the ER's share based on the Total Basic and as for as EE's share he can contribute more than 12% as he wish as VPA or if you need any further clarification you can check with the concern PF officer for the adjustment. but you cann't deduct simply from the EE....

Actually after reading your messages, the case is not clear? in fact, You should understand the basic things about PF, like; who is eligible? how much amount should be deducted? when and where to be deposited? what are certain documents to be submitted to PF department (monthly and yearly)?
As far as there is the question of outsourcing the Statutory requirement then also you must know the answers of all the questions mentioned above and your problem will be resolved automatically.
You need to calculate at your own and compare with outsourcing people.
